Terms & Conditions 

 

The basis of this contract is to establish an agreement to how services provided by this website shall be used and how products will be sold. By using the services or purchasing goods, you are agreeing to the terms and conditions outlined below. 

 

1. Payment 

1a. All payments are taken using Wix Payments; a fully SSL certified payment processor secured by HTTPS / TLS encryption. TLS is the industry standard and is used by millions of websites in the protection of their online transactions with their customers. I will, at no point, have any access to your card details as payments will be made directly through the secure servers of Wix Payments. 

 

2. Ownership of rights 

2a. All rights, including copyright in this website are owned by Daniel Kay Photography. Any use of this website or its contents, including copying or storing other than for your own personal, non-commercial use are prohibited without my permission.   

 

3. Returns

3a. All items produced are either ‘Custom made’ or ‘made to order’. Under UK law, these products are exempt from internet distance selling rules and thus, I will only offer refunds for faulty/damaged goods.  

 

3b. Please make sure that you have selected the correct sizes/options and are happy before committing to the purchase of an item.  

3c. If you receive a product which is damaged, you will have 14 days from the date you received your goods to return the item. To be eligible for a return, the item must be unused and in the same condition as received.  

 

4. Price

4a. The prices payable for goods/services that you order are as set out on my website.  

 

5. Shipping

5a. I will deliver the goods to the address that you provide in your order. Please make sure you have entered the address correctly. I am not responsible for any loss or damage to goods once they have been delivered in accordance with your delivery instructions, unless there is negligence on my part.  

 

5b. I will endeavour to deliver your items by the date quoted at purchase however, delivery times are not guaranteed and in some rare instances, delivery may be slightly delayed. If a delivery is delayed beyond the point of 14 days (from the day after purchase) I will make contact with you to either agree on an alternative date or offer a full refund. 

5c. There are occasions where I may be away on vacations and will sadly not be able to process any orders. If this is the case, there will always be a message to notify users on the header section of my website. Any orders placed within the dates that I am away will be dealt with swiftly as soon as I return. In some cases, it may still be possible to process certain orders within the specified vacation dates. Please do not hesitate to contact me, as I will more than likely be able to respond to all correspondences.  

 

5d. Shipping costs for return items will be at the responsibility of the buyer. 

 

6. Cancellations

6a. As detailed above in the ‘Returns’ sections, I am not obliged to offer refunds if you have changed your mind. All my products are ‘custom made’ or ‘made to order’ and once created, I am unable to reclaim these expenses. In certain circumstances, it may be possible (if product has not been created/ordered) to offer a refund, however this will be at my discretion.  

 

6b. I reserve the right not to process your order if; 

You live outside of the area that I deliver to; or 

One or more of the items you have ordered were listed at an incorrect price either due to a typographical error or an incorrect price quotation given to me by a supplier. 

Instances such as these are very rare and, in such instance, I will contact you to arrange a full refund or come to a mutual agreement on how to proceed further. 

 

7. Changes to legal notices

7a. I reserve the right to change these terms and conditions at any time.
